These cannot be selfownership rights, or so I shall argue. The argument of the book may be seen, therefore, as a critique of self-ownership and an attempt to argue for a notion of self-government. Self-ownership is understood as the doctrine that each human being is the morally rightful owner of her person and powers. She may do as she pleases as long as she does not harm others. So what it means to have a right is to have a certain proprietary control over the domain specified as the object of the right.

And is proprietary power the only available power for us to plug into if we are to give content to the notion of self-command or individual moral sovereignty that our language of rights is aimed to capture? In considering the first question we should not overlook the fact that self-ownership embraces the most important claim of slavery: that people can be the objects of private property rules. This is the claim which must be rebutted if slavery is to be overcome. In fact, the doctrine of self-ownership offers no challenge to slavery as such.

Are rights connected with separation from the community? Is talk of rights nonsense? Are all rights legal rights? While giving a negative answer to those questions, I will try to show how the good sense in the points made in support of the positions they summarize is accommodated in the theory of rights as political. 47 Rawls, ‘Justice as Fairness: Political not Metaphysical’.
